Frequently Asked Questions

LONG TERM DISABILITY/ERISA

3. What steps can I take to obtain long term disability benefits?

Most long term disability insurance policies have an administrative appeal procedure which requires you to provide evidence of disability to the insurance company in order to receive benefits. After you have gone through this administrative appeal procedure, if the insurance company continues to deny you long term disability benefits, then you have the right to file a law suit. Typically long term disability claims are litigated in federal court. At Farrell & Gasparo, P.A., we handle long term disability cases all the way from the administrative appeal procedure to federal court, and to a federal trial if necessary.
