4. What lost wage benefits are available under workers’ compensation?

Under the Florida law, your employer and/or workers’ compensation insurance company is required to pay you 66 2/3 of your average weekly wage during periods that you are temporarily disabled by a work related injury. If you receive a permanent injury which partially disables you, you are eligible for additional benefits based on the degree of permanent impairment to you, which is established by your authorized treating physician. If your work related injury permanently disables you from any type of employment, you may be eligible for a benefit called Permanent Total Disability benefits which are paid out over the remainder of your lifetime. Sometimes the employer/insurance company denies payment of lost wage benefits even if the employee is unable to work. If this happens, the assistance of an attorney may be required.
